Terms and Conditions of the Promotion "BONUS 1500"
§ 1. General provisions
1. These Terms and Conditions ("Terms and Conditions") define the terms, conditions and duration of the "Bonus 1,500" promotion ("Promotion").
2. The Organizer of the Promotion ("Organizer") is FOLGA Sp. z o. o. with its registered office in Toruń, ul. Grudziądzka 110-114/304, 87-100 Toruń, registered in the National Court Register - Register of Entrepreneurs under the KRS number: 0001142532, NIP 9562344169.
3. For the purposes of the Promotion, the following definitions apply:
a. "Participant" – a natural person taking part in the Promotion, meeting the requirements specified in § 3 section 1 of the Regulations,
b. "Promotion" – the promotion described in these Regulations,
c. "Prize" - the prize described in § 4 section 1 of the Regulations
d. “Promotion Duration” – the duration of the Promotion specified in § 2 of the Regulations.
e. "GDPR" - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
§ 2. Duration of the Promotion
1. The Promotion is conducted in the territory of the Republic of Poland and lasts from 7 July 2025 to 15 October 2025.
2. The Promotion may be terminated by the Organizer before the deadline specified in paragraph 1 if the Prize pool is exhausted. The Organizer undertakes to inform Participants about the early termination of the Promotion via the website https://folga.com.pl
§ 3. Promotion Participants
1. The Promotion is open to a Participant who is a natural person and who:
a. has full legal capacity,
b. will conclude a contract for services with the Organizer, the subject of which will be the performance of services in the shops with the numbers indicated in Annex No. 1, during the Promotion period, and the break between the new contract for services and the previous one will be no shorter than 1 month,
c. expresses willingness to participate in the Promotion by filling in the application form (the form is available at the link provided by the Organizer via website www.folga.com.pl , www.pracawbiedronka.folga.com.pl or by contacting a Folga recruiter by July 25, 2025,
d. will perform the order referred to in letter b, during the Promotion period for at least 540 hours.
3. Participation in the Promotion is voluntary and free of charge.
4. Before taking part in the Promotion, the Participant should read these Regulations. The Organizer declares that the text of these Regulations is available on the website https://folga.com.pl and at the Organizer's registered office. Taking part in the Promotion and sending the Organizer an application is tantamount to reading the Regulations and accepting them, as well as giving consent to the processing of personal data solely for the purpose of conducting this Promotion, https://folga.com.pl
5. The Organizer is not responsible for the content of the application and the content of materials sent by Participants. The Organizer reserves the right to verify data by phone, remove and disregard applications containing content that is offensive, vulgar or otherwise violates the dignity and good name of third parties or otherwise violates the law or good customs.
6. Participants undertake to provide true personal data. The truthfulness of the personal data provided may be verified by the Organizer at the time of receiving the Prize, based on a document confirming identity presented by the Participant.
7. The Organiser reserves the right to reject entries from the Promotion in respect of which there is a reasonable suspicion that they or persons acting in their interest have sent entries providing fictitious data.
8. The Organizer is obligated to inform about the rejection of the submitted application along with the reason. Such information will be sent using private messages via e-mail to the address provided in the application.
§ 4. Prizes.
1. The prize in the Promotion is PLN 1,500 (in words: one thousand five hundred) gross.
2. The prize will be paid by 25/11/2025.
3. The Participant may not transfer the right to receive the Prize to other persons.
§ 5. Complaints
1. Any complaints regarding the course of the Promotion may be submitted by Participants in writing under penalty of nullity to the address Folga Sp. z o. o., ul. Grudziądzka 110-114/304, 87-100 Toruń with the note "Premium 1,500" throughout the duration of the Promotion. The date of receipt of the complaint by the Organizer shall be decisive for meeting the deadline for filing the complaint, no later than 5.12.2025.
2. Complaints should include the data of the Promotion Participant, the Participant’s correspondence address, a detailed description and indication of the reason for the complaint and a specification of the request.
3. Complaints submitted will be considered without undue delay, but no later than within 14 working days (in words: fourteen) from the date of receipt of the complaint.
4. The response to the complaint will be sent by registered mail to the Participant’s correspondence address provided in the complaint.
5. After unsuccessfully exhausting the complaints process, Participants have the right to pursue their claims in court proceedings.
6. This complaint procedure does not exclude, limit or suspend the Participant's rights and does not preclude the Participant from pursuing any claims under generally applicable provisions of law.
§ 6. Personal Data
1. The administrator of personal data provided by the Promotion Participants will be the Organiser.
2. Personal data will be processed for the following purposes:
a. in order to participate in the Promotion, join the promotion and award the Prize, and the basis is Article 6 section 1 letter a of the GDPR – voluntary consent of the Participant,
b. for the purpose of direct telephone or electronic contact in connection with the registration for the Promotion and joining the Promotion – pursuant to Article 6 paragraph 1 letter a of the GDPR, based on voluntary consent;
c. for purposes related to tax settlements and fulfillment of other obligations arising from legal provisions, including reporting obligations, and the basis is Article 6 paragraph 1 letter c) of the GDPR – necessity to fulfill the legal obligation incumbent on the administrator;
d. in the case of additional consent – also for the purpose of direct marketing, in particular for the purpose of sending information about products, promotions and services provided and submitting offers and proposals to conclude a contract and in this respect for direct electronic contact via electronic mail (e-mail), and the basis is Art. 6 sec. 1 letter a of the GDPR and Art. 172 of the Act of 16 July 2004 – Telecommunications Law (i.e. of 15 September 2017, Journal of Laws of 2017, item 1907, as amended) – voluntary consent of the user and Art. 6 sec. 1 letter f) of the GDPR – legitimate interest of the administrator solely in the scope of data storage.
- Participants' personal data may be transferred to entities with which the Organizer cooperates within the scope of its business activity, including entities providing legal, accounting, HR, banking, insurance, property protection and IT services to it. The recipients of personal data will or may also be law enforcement authorities, courts and public administration bodies.
- Participants' personal data will not be transferred to a third country (a country outside the European Economic Area) or an international organisation.
- The personal data of Participants will be stored until the consent is withdrawn. After the consent is withdrawn, the personal data will be deleted from the Administrator's IT systems and the paper documents will be destroyed;
- The Participant has the right to access the content of his/her data and the right to rectify it,
- The participant has the right to request the deletion of personal data at any time,
- The participant has the right to request the restriction of the processing of personal data,
- The Participant has the right to transfer data in a commonly used format that allows, for example, printing or saving in computer memory,
- The participant has the right to object to further processing of data,
- Each of the rights listed in points 7 to 11 may be exercised by the Participant by sending an appropriate application in writing to the address of the Administrator's registered office with the note personal data or in electronic form by sending an e-mail to the address iod@must-consulting.pl
- The Participant has the right to lodge a complaint with the President of the Personal Data Protection Office if he or she considers that the processing of personal data violates the provisions of the GDPR.
§ 7. Final provisions
1. The Regulations are the only document specifying the rules of the Promotion.
2. The Organizer is not responsible for any technical problems that are not caused by the Organizer.
3. All information about the Promotion contained in any promotional and advertising materials is of an auxiliary nature only, while the scope of rights of the Participants and the Organiser is regulated and assessed on the basis of the provisions of these Regulations.
4. The Organizer reserves the right to change the Regulations, provided that this does not result in a deterioration of the conditions of participation in the Promotion.
5. Both the Participants and the Organiser will strive to resolve any disputes arising from the Regulations in an amicable manner, through negotiation.
6. The Organizer's liability towards the Participant shall in no case exceed the value and number of Prizes specified in these Regulations. The limitation of liability referred to in the preceding sentence shall not apply to situations in which such limitation of liability is contrary to applicable law, and in particular shall not apply to damages caused by the Organizer through an unlawful act or through culpable conduct.
7. The current version of the Regulations will be available on the website https://folga.com.pl and at the Organizer's registered office.
8. The Promotion is not a game of chance, a lottery, a mutual bet or a promotional lottery, the result of which depends on chance (drawing) within the meaning of Art. 2 of the Gambling Act of 19 November 2009.
9. Any disputes arising from the performance of obligations related to the Promotion will be resolved by a court of general jurisdiction.
10. The law applicable to the Promotion and to the assessment of the rights and obligations of Participants is Polish law.
11. The Regulations shall enter into force on 7 July 2025.
