Dear User,
In this document you will find a number of rules and information related to your use of our website available at folga.com.pl ("Portal").
Basic information
The owner of the Portal is FOLGA Sp. z o. o. (formerly: FOLGA SA) in Toruń (87-100), ul. Grudziądzka 110-114 (KRS 0001142532, NIP 9562344169, REGON 382286256).
Contact with FOLGA Sp. z o. o. (formerly: FOLGA SA) ("Company") is possible in two ways:
– traditional – by sending a letter to the Company’s address indicated above or
– electronic – by sending an e-mail to the address biuro@folga.com.pl or by using the contact form available on the Portal subpage https://folga.com.pl/
Terms of Use
This document ("Terms and Conditions") defines the terms and conditions of providing services electronically through the Portal and is permanently and freely available on the appropriate subpages of the Portal. Any person who uses the Portal ("User") may download, save, open or print these Terms and Conditions at any time. By using the Portal, the User agrees to the provisions of the Terms and Conditions.
The Portal is available to Users who are over 18 years of age and have full legal capacity.
The Portal is aimed at Users looking for temporary work or looking for a temporary work agency with which they could start cooperation. The Portal publishes, among other things, job offers available from the Company's contractors, as well as other information about the Company's business activities.
Subject to possible failures, the Portal is available 24 hours a day, 7 days a week.
To use the Portal, the User must have a device with Internet access (it can be a computer, tablet or smartphone) with an installed web browser. The User who intends to use the provided contact form should also have an active e-mail address to which the Company will send a response.
When using the Portal it is prohibited to:
- providing and transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
- using the Portal in a way that disrupts its functioning, in particular through the use of specific software or devices,
- taking actions such as sending unsolicited commercial information (spam) via or posting it on the Portal,
- using the Portal in a manner that is burdensome to other Users and to the Company or its representatives,
- violating any intellectual property rights of the Company,
- using the Portal in a manner inconsistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with good customs of using the Internet.
The use of any service provided electronically (online), which also applies to the use of the Portal, may involve the risk that unauthorized third parties will gain access to the User's computer system without his/her consent or knowledge. In the case of the Portal, this risk is the same as in the case of other such activities on the Internet. In order to minimize this risk, the User should take care of the protection of their system on their own, taking appropriate steps in this direction (e.g. installing an antivirus and antimalware program) and following the basic principles of browsing the Internet. The Company undertakes to use only such applications and programs within the Portal that will provide an adequate level of data protection.
Intangible rights
All materials and content made available or published on the Portal, regardless of their form, including in particular: text, graphics, logos, icons, images, photos, audio files, video files and audio-video files, are protected by copyright belonging to the Company or other entities.
Reproduction or distribution, in whole or in part, of the materials and content referred to above, in any form or by any means, without the prior express consent of the Company or the entity that owns the rights to the material, is prohibited, unless applicable law allows such reproduction or distribution.
The use of the Portal by the User does not result in the transfer by the Company to that User of any rights, including ownership, to the materials and content provided.
Newsletter
The Company provides a service on the Portal to send messages containing marketing and commercial information of the Company to the e-mail address provided by the User (Newsletter Service). The frequency of sending messages will be determined solely by the Company.
In order to use the Newsletter, the User should provide their e-mail address, consent to the processing of their personal data on the principles described in more detail in the Portal Privacy Policy and then confirm their willingness to subscribe to the Newsletter by clicking the activation link that the Portal system will send to the User's e-mail address. Failure to activate the Newsletter service within 24 hours of sending the message with the activation link will mean resignation from the Newsletter service.
To use the Newsletter service, the User must have an active electronic mailbox (e-mail).
By subscribing to the Newsletter, the User accepts the provisions of these Regulations.
The Newsletter service is free of charge.
The User acknowledges that the Company will send messages to the email address provided by him/her as part of the Newsletter service until the User resigns from receiving these messages. Resignation from the Newsletter service may be sent by email to the Company's contact address or via a form prepared for this purpose.
Applying for a job
The Company provides a service on the Portal enabling application for job vacancies available on the Portal with contractors cooperating with the Company.
In order to use this service, the User should click the "Apply" button next to the job offer they are interested in. They will then be redirected to a special subpage containing more information about the job offer. If they wish to report their intention to participate in the recruitment process for this job position, the User should fill in the application form available on this subpage by entering their name, surname, telephone number, and - voluntarily - VIBER number and e-mail address, and then consent to the processing of personal data and to the provisions of the Regulations.
To use this service, it is necessary for the User to provide the Company with a telephone number in order to enable contact.
The job application service is free of charge and is available until the recruitment process for a given position is completed.
Chat
The Company provides a service on the Portal enabling communication between the User and a representative of the Company via the Viber or Messenger application.
In order to use this service, the User should click the "Chat" button located in the lower right corner of the Portal, and then select the type of messenger (Viber or Messenger) through which the User wants to contact the Company.
The User acknowledges that in order to use this service, it is necessary for him/her to have one of the messengers (Viber or Messenger). The terms of use of these messengers are determined by the provider of the given messenger.
Using the chat service on the Portal is free of charge.
Using the chat service constitutes acceptance of the provisions of the Regulations and the Privacy Policy.
Request for quotation
The Company provides a service on the Portal enabling other entrepreneurs to establish business relations with the Company.
In order to use this service, the User should click the "Request for quotation" button, fill out the form available on the Portal by providing their name, surname, e-mail address, contact number, name of the entity that the User represents, the city in which the entity operates and the content of the message addressed to the Company, and then consent to the processing of personal data and the provisions of the Regulations.
The User acknowledges that in order to use this service it is necessary to have and provide the Company with a telephone number and an active e-mail address in order for the Company to contact them.
Using this service is free.
Complaint procedure
A User dissatisfied with the way the Portal functions may file a complaint using one of the available forms of contact with the Company.
Notifications and complaints should include a description of the situation or problem and the User's contact details, such as his or her name, surname and contact address.
The Company will respond to the complaint within 14 days of its receipt to the contact address provided by the User.
Personal data
The Company is the administrator of the User's personal data. Detailed provisions specifying the scope and method of processing of the User's personal data by the Company are included in a separate document - Privacy Policy (link).
Extrajudicial methods of resolving disputes
A user who is a consumer within the meaning of Article 221 kc or an entrepreneur in accordance with art. 431 kc, if the law grants the entrepreneur rights to which the consumer is entitled, he has, among others, the following possibilities of using out-of-court methods of handling complaints and pursuing claims:
- is entitled to refer the dispute to a permanent consumer arbitration court operating at the Trade Inspection Authority;
- is entitled to request the provincial inspector of the Trade Inspection to initiate mediation proceedings to amicably settle the dispute between the User and the Company;
- may obtain free assistance in resolving a dispute between the User and the Company, also using the free assistance of the district (municipal) consumer advocate or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, the Association of Polish Consumers). Advice is provided by the Consumer Federation on the free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address porad@dlakonsumentow.pl;
- submit your complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.
Final provisions
In matters not regulated in the Regulations, the provisions of generally applicable Polish law shall apply.
The Regulations come into effect upon their announcement by the Company. The Company reserves the right to change the Regulations at any time. The Company will inform Users about changes to the Regulations via the Portal and/or in a special message sent to an e-mail address known to the Company.
