Terms and Conditions of the “Cash for Referral” Promotion

§ 1. General provisions

1. These Regulations ("Regulations") define the terms, conditions and duration of the "Cash for Referral" promotion ("Promotion").

2. The Organizer of the Promotion ("Organizer") is FOLGA Sp. z o. o. ul. Grudziądzka 110-114/304, 87-100 Toruń, registered in the National Court Register - register of entrepreneurs under the KRS number 1142532 NIP: 9562344169

§ 2. Definitions

For the purposes of the Promotion, the following definitions apply:

a. "Recommending Person" – a natural person recommending a candidate for a vacant position, taking part in the Promotion, meeting the requirements specified in § 4 section 1 of the Regulations,

b. Recommended person – a person indicated by the Recommending Person as a potential candidate

b. "Promotion" – the promotion described in these Regulations,

c. "Prize" - the prize described in § 5 section 1 of the Regulations

d. “Promotion Duration” – the duration of the Promotion specified in § 3 of the Regulations.

e. "Fan Page" – the Organizer's commercial profile maintained on the social networking site Facebook.com, available at:  www.facebook.com/folga.polska  and Instagram.com, available at: www.instagram.com/grupa_folga .

f. "GDPR" - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

§ 3. Duration of the Promotion

1. The Promotion is conducted in the territory of the Republic of Poland and lasts from 16 June 2025 to 30 September 2025.

2. The Promotion may be terminated by the Organizer before the deadline specified in paragraph 1 if the pool of Prizes is exhausted. The Organizer undertakes to inform the Recommending Persons about the early termination of the Promotion via the website www.folga.com.pl

§ 4. Promotion Participants

1. The Promotion is open to a Recommending Person who is a natural person and who:

a. has full legal capacity,

b. expresses willingness to participate in the Promotion by submitting a form available on the website www.folga.com.pl and filling in the appropriate field with the personal data of a third party (Recommended Person), and this person will take up employment with the Organizer
(in any of the following legal forms: employment contract, contract of mandate, contract for specific work) during the Promotion period,

c. consents to the publication of his/her name and surname on the website www.folga.com.pl and the Organizer’s Fan Page in the event of being awarded the Prize.

2. The Recommending Person shall join the Promotion upon expiry of the one-month period of employment by a third party (Recommended Person), referred to in § 4 section 1b of the Regulations, using the Recommending Person's recommendation, with the Organiser or an entity affiliated with the Organiser by capital or personal links, but no later than on the day of the end of the Promotion, after the Recommended Person has worked at least 200 (two hundred) hours.

a. The recommended person must be an adult,

b. The recommended person cannot be a person previously or currently employed by the Organizer or any entity affiliated with it personally or financially,

c. The recommended person, on the date of application, cannot be in the recruitment process of the Organizer or entities related to it by capital or personal links,

d. a given Recommended Person may be recommended only by one Recommending Person, maximum once every 12 months counted from his/her employment,

e. in a situation where more than one Recommending Person in the Promotion recommends the same Recommended Person, the date and time of completing the form indicated in § 4 section 1 letter b. is taken into account. This means that only one person who was the first to recommend a given Recommended Person may receive the Prize.

3. Participation in the Promotion is voluntary and free of charge.

4. Persons employed (on any basis, e.g. employment contract, contract for specific work, b2b) by the Organizer or entities affiliated with it by capital or personal ties, whose duties include recruiting employees, are excluded from the Promotion.

5. Before taking part in the Promotion, the Recommending Person should read these Regulations. The Organizer declares that the text of these Regulations is available on the website www.folga.com.pl and at the Organizer's office. Taking part in the Promotion and sending the Organizer an application is tantamount to reading and accepting the Regulations and to expressing consent to the processing of personal data solely for the purpose of conducting this Promotion, publishing information about the winning Prize on the website www.folga.com.pl and the Organizer's Fan Page and distributing the Prizes in accordance with § 5 of the Regulations.

6. The Organizer is not responsible for the content of the application and the content of materials sent by Recommending Persons. The Organizer reserves the right to verify data by telephone, remove and disregard applications containing content that is offensive, vulgar or otherwise violates the dignity and good name of third parties or otherwise violates the law or good customs.

7. The Promoter informs that the Promotion is in no way sponsored, endorsed, administered by or associated with Facebook or Instagram. Facebook and Instagram are administered by Meta Platforms Ireland Limited. The information provided by the Referrer is information provided to the Promoter and not Meta Platforms Ireland Limited and will be used solely for the purpose of conducting the Promotion.

8. The recommending person undertakes to provide true personal data. The truthfulness of the indicated personal data may be verified by the Organizer at the time of receipt of the Prize, based on a document confirming identity presented by the recommending person.

9. The Organiser reserves the right to reject entries from the Promotion in respect of which there is a suspicion, based on justified circumstances, that they or persons acting in their interest have sent entries providing fictitious data.

10. The Organizer is obligated to inform about the rejection of the submitted application along with the reason. Such information will be sent using private messages via e-mail to the address provided in the application.

§ 5. Prizes.

1. The prizes are financed from the Organizer's own funds.

a) The Prizes in the Promotion are specified in Annex 1 to these Regulations and their amount depends on the position for which the Recommended Person will be nominated.

      2. The prize will be paid within 14 days of joining the Promotion, as referred to in §4 section 2 of the Regulations.

      3. The recommending persons will be informed by the Organizer about the Prize using private messages via e-mails indicated in the application. The recommending persons are obliged to provide the Organizer with all data necessary for the settlement of tax or other public law liabilities.

      4. If the Organiser is unable to contact the Recommending Person for any reason or does not receive a response to the Prize notification within 7 days of the date of notification, the Organiser reserves the right not to issue the Prize.

      5. In the event of the Recommending Person refusing to accept the Prize, the Organiser shall not be obliged to transfer the Prize. The Organiser shall not be liable for the impossibility or difficulties in collecting the Prize due to reasons attributable to the Recommending Person.

      6. The recommending person may not transfer the right to receive the Prize to other persons.

      § 6. Complaints

      1. Any complaints regarding the course of the Promotion may be submitted by Recommending Persons in writing under penalty of nullity to the address FOLGA Sp. z o. o., ul. Grudziądzka 110-114/304, 87-100 Toruń with the note "Promocja Kasa za rekomenda" (Cash for Recommendation Promotion), throughout the duration of the Promotion. The deadline for filing a complaint is determined by the date of its receipt by the Organizer, no later than December 31, 2025.

      2. Complaints should include the details of the Recommending Person, the correspondence address of the Recommending Person, a detailed description and indication of the reason for the complaint and a specification of the request.

      3. Complaints submitted will be considered without undue delay, but no later than within 14 (in words: fourteen) days from the date of receipt of the complaint.

      4. The response to the complaint will be sent by registered letter to the correspondence address of the Recommending Person provided in the complaint.

      5. After unsuccessfully exhausting the complaints process, the Recommending Persons have the right to pursue their claims in court proceedings.

      6. This complaint procedure does not exclude, limit or suspend the rights of the Recommending Person, nor does it preclude the pursuit of any claims by the Recommending Person on the basis of generally applicable provisions of law.

      § 7. Personal Data

      1. The administrator of personal data provided by recommending persons will be the Organizer.

      2. Personal data will be processed for the following purposes:

      a. in order to participate in the Promotion, join the promotion and award the Prize, and the basis is Article 6 section 1 letter a of the GDPR – voluntary consent of the Recommending Person,

      b. for the purpose of direct telephone or electronic contact in connection with the registration for the Promotion and joining the Promotion – pursuant to Article 6 paragraph 1 letter a of the GDPR, based on voluntary consent;

      c. for purposes related to tax settlements and fulfillment of other obligations arising from legal provisions, including reporting obligations, and the basis is Article 6 paragraph 1 letter c) of the GDPR – necessity to fulfill the legal obligation incumbent on the administrator;

      d. in the case of additional consent – also for the purpose of direct marketing, in particular for the purpose of sending information about products, promotions and services provided and submitting offers and proposals to conclude a contract and in this respect for direct electronic contact via electronic mail (e-mail), and the basis is Art. 6 sec. 1 letter a of the GDPR and Art. 172 of the Act of 16 July 2004 – Telecommunications Law (i.e. of 15 September 2017, Journal of Laws of 2017, item 1907, as amended) – voluntary consent of the user and Art. 6 sec. 1 letter f) of the GDPR – legitimate interest of the administrator solely in the scope of data storage.

      3. The personal data of the Recommenders may be transferred to entities with which the Organizer cooperates within the scope of its business activity, including entities providing legal, accounting, HR, banking, insurance, property protection and IT services to it. The recipients of personal data will or may also be law enforcement authorities, courts and public administration bodies.

      4. The personal data of Recommending Persons will not be transferred to a third country (a country outside the European Economic Area) or an international organisation.

      5. The personal data of the Recommending Persons will be stored until the consent is withdrawn. After the consent is withdrawn, the personal data will be deleted from the Administrator's IT systems and the paper documents will be destroyed;

      6. The recommending person has the right to access the content of his/her data and the right to rectify it,

      7. The recommending person has the right to request the deletion of personal data at any time,

      8. The recommending person has the right to request the restriction of the processing of personal data,

      9. The recommending person has the right to transfer data in a commonly used format that allows, for example, printing or saving in computer memory,

      10. The recommending person has the right to object to further processing of data,

      11. Each of the rights listed in points 7 to 11 may be exercised by the Participant by sending an appropriate application in writing to the address of the Administrator's registered office with the note personal data or in electronic form by sending an e-mail to biuro@folga.com.pl

      12. The recommending person has the right to lodge a complaint with the President of the Personal Data Protection Office if he or she considers that the processing of personal data violates the provisions of the GDPR;

        § 8. Final provisions

        1. The Regulations are the only document specifying the rules of the Promotion.

        2. The Organizer is not responsible for any technical problems that are not caused by the Organizer.

        3. All information about the Promotion contained in any promotional and advertising materials is of an auxiliary nature only, while the scope of rights of the Recommenders and the Organiser is regulated and assessed on the basis of the provisions of these Regulations.

        4. The Organizer reserves the right to change the Regulations, provided that this does not result in a deterioration of the conditions of participation in the Promotion.

        5. Both the Recommending Persons and the Organiser will strive to resolve any disputes arising from the Regulations in an amicable manner, through negotiation.

        6. The liability of the Organizer towards the Recommending Person shall in no case exceed the value and number of Prizes specified in these Regulations. The limitation of liability referred to in the preceding sentence shall not apply to a situation in which such limitation of liability is contrary to applicable law, and in particular shall not apply to damages caused by the Organizer as a result of an unlawful act or through culpable conduct.

        7. The Regulations have been drawn up in the following language versions: Polish, Russian, Ukrainian and Spanish, and in case of any doubts, the Polish version shall prevail.

        8. The current version of the Regulations will be available on the website www.folga.com.pl and at the Organizer's registered office.

        9. The Promotion is not a game of chance, a lottery, a mutual bet or a promotional lottery, the result of which depends on chance (drawing) within the meaning of Art. 2 of the Gambling Act of 19 November 2009.

        10. Any disputes arising from the performance of obligations related to the Promotion will be resolved by a court of general jurisdiction.

        11. The law applicable to the Promotion and to the assessment of the rights and obligations of Participants is Polish law.

        12. The Regulations shall enter into force on 16 June 2025.
